Privacy Policy

Effective date: September 1, 2026

1. Who we are

This website (yohda.audio) and our email signup are operated by YOHDA, a premium audio-plugin company currently in pre-launch. Our forming legal entity is Yohda Audio, LLC (“YOHDA,” “we,” “us”), a Delaware limited liability company currently in formation, acting through its founders. We are based in Los Angeles (United States) and offer our products globally.

For the purposes of the EU General Data Protection Regulation (GDPR), which applies where we offer products to individuals in the EU/EEA, the data controller is YOHDA. Our full registered address will be provided once the entity is formed, and we will update this controller identity accordingly.

Contact for privacy matters: privacy@yohda.audio.

2. Data protection contact

We are not legally required to appoint a Data Protection Officer, because our processing does not involve large-scale monitoring or special categories of data. For any data-protection question, or to exercise your rights, contact us at privacy@yohda.audio.

3. What we collect

When you sign up, we collect:

Through our email provider we also process limited technical information linked to your subscription, such as sign-up and confirmation timestamps, and email delivery and engagement data (for example, whether a message was delivered or opened). We do not collect special categories of data (such as health, political, or biometric data), and we do not ask for such data.

4. Why we use your data, and our legal basis

We use your data only for the purposes below, on the legal basis of your consent under Article 6(1)(a) GDPR:

Providing your data is not a statutory or contractual requirement and you are under no obligation to provide it — but if you do not give us your email address, we cannot send you our marketing communications.

Withdrawing consent. You can withdraw your consent at any time — it is as easy to withdraw as it was to give — by clicking the unsubscribe link in any email or emailing privacy@yohda.audio. Withdrawing your consent does not affect the lawfulness of any processing we carried out before you withdrew.

5. Double opt-in and “pending” addresses

We use a double opt-in process. When you submit your email:

Double opt-in helps us prove valid consent and confirm that the address belongs to you.

6. How long we keep your data

7. Who processes your data

We use Brevo (operated by Sendinblue SAS, 106 boulevard Haussmann, 75008 Paris, France; with a US affiliate, Sendinblue, Inc.) as our email service provider, acting as our processor under a data processing agreement. Brevo hosts our subscriber databases within the EU. We do not sell your personal data and do not share it for third-party marketing. We may disclose data where legally required (for example, in response to a lawful request from authorities).

8. International transfers

Because YOHDA is based in the US and offers its products globally, your data may be accessed or processed outside your home country, including outside the European Economic Area (EEA). Your subscriber data is hosted by Brevo within the EU, which limits transfers. Where personal data is transferred to the US (for example, to our US operations or to Brevo’s US affiliate), we rely on the EU–U.S. Data Privacy Framework (DPF) where the recipient is DPF-certified — Sendinblue, Inc. is certified under the EU–U.S. DPF — and on the European Commission’s Standard Contractual Clauses (SCCs) as a fallback safeguard. You can request a copy of the relevant safeguards by emailing privacy@yohda.audio.

9. Your rights

If you are in the EU/EEA, you have the right to: access your data; rectify inaccurate data; erase your data; restrict processing; object to processing; data portability; and withdraw consent at any time (see Section 4). You also have the right to lodge a complaint with a data protection supervisory authority.

You may lodge that complaint with the data protection supervisory authority in your own country of residence.

No automated decision-making. We do not make decisions about you based solely on automated processing, including profiling, that produce legal or similarly significant effects.

California (CCPA/CPRA)

If you are a California resident, you have rights to know/access, delete, and correct your personal information, and to opt out of the “sale” or “sharing” of personal information. We do not sell or share your personal information as those terms are defined under California law, and we do not use it for cross-context behavioral advertising. The categories we collect are identifiers (your email address) and internet/electronic activity information (confirmation and delivery data), collected for the purposes in Section 4 and retained as in Section 6.

United Kingdom

If you are in the UK, you may also complain to the UK Information Commissioner’s Office (ICO).

To exercise any of these rights, email privacy@yohda.audio. We will verify your request and respond within the timeframes required by applicable law.

10. How we protect your data

We use appropriate technical and organizational measures to protect your data, including encryption in transit, access controls, and working only with a reputable processor (Brevo) that maintains recognized security certifications (including ISO 27001). No system can be guaranteed completely secure, but we take reasonable steps to protect your information and to detect and respond to incidents. If a personal data breach occurs that is likely to affect your rights, we will notify the competent supervisory authority and, where required, you, in line with our legal obligations.

11. Cookies and analytics

We keep tracking to a minimum. We use Vercel Web Analytics, a privacy-friendly, cookieless analytics tool, to understand how our site is used (for example, page views and general traffic patterns). Vercel Web Analytics does not use cookies and does not create individual user profiles or track you across other websites; visitors are identified by an anonymized hash created from the incoming request, and the visitor session is automatically discarded after 24 hours. We see only aggregated, anonymous statistics. If we add cookies or other tracking in future, we will update this policy and provide any consent controls required by law.

12. How to unsubscribe

Every marketing email contains a clear, working unsubscribe link. You can also email privacy@yohda.audio. We honor opt-out requests promptly and, for US recipients, within 10 business days as required by the CAN-SPAM Act; our unsubscribe mechanism stays active for at least 30 days after each message. We then add you to a suppression list so you are not contacted again.

13. Children

Our website and signup are not directed to children, and we do not knowingly collect data from children. If you believe a child has provided us data, contact privacy@yohda.audio and we will delete it.

14. Changes to this policy

We may update this policy from time to time. We will post the revised version here with a new effective date, and we will update our controller identity and registered address once our entity is formed.
